Divorce Registration (When you are getting a divorce)
When will the registration become valid?
The divorce will become effective on the day the notification is submitted.

What is needed to submit the registration?
- The Divorce Registration (A document sealed and signed by two adults witnessing their marriage.)
- Official copy of the family register (Only needed if your permanent residence is not Kobayashi-City)
- Seal of the person submitting the registration
When foreign nationals are involved
Foreigners living in Japan are required to registrate their divorce by submitting a Divorce Notification to the Kobayashi-City Hall as well as notify their native country. In case of an amicable divorce (both parties agree on it) the divorce is valid under Japanese law. Whether the divorce is valid in the foreigners home country varies depending on that country's law.
Concerning the family name
If you want to keep the name you adopted as your family name at the time of marriage, the respective notification has to be submitted. You can submit the request along with the Divorce Notification.
Until when to submit?
Within three months from the day after the divorce (Can be submitted at the same time as the Divorce Registration).

Who can submit the notification?
The person who is getting a divorce but wants to prevent having to readopt his or her former family name.
What is needed to submit the notification?
- The notification form stating that you want to keep your current name
- Official copy of the family register (Only needed if you are Japanese and your permanent residence is not Kobayashi-City. Must not necessarily be submitted at the same time as the Divorce Registration)
- Seal of the person submitting the notification
Regarding child's name and family register entry
If you want to add your child to your family register, you need to file a Notification for Entry in Family Register. (nyuuseki todoke)
Who can submit the request?
For children under 15 years of age, a parent (or persons with parental authority) needs to submit the request. Children above 15 years of age need to submit the request by themselves.
Confirmation about Parental Authority
Please confirm the Parental Authority over the child that is supposed to be added to your family register.
In case you do not hold Parental Authority, you are needed to submit a Parental Authority Notifcation with permission by a Family Court. Please consult the Resident Affairs Devision for further information.
What is needed to submit the notification?
- Notification for Entry in Family Register (nyuuseki todoke), available at the Counter (madoguchi) at the Resident Affairs Division
- A Certified Copy of the verdict allowing the child's family name change (a document verifiying the gained permission by a Family Court)
- An Official Copy from the applicant's Family Register Entry (koseki touhon) as well as from the child.
About the Permission of a child's family name change
If the divorce procedures are completed, you can prepare the following documents and consult a Family Court to gain permission for your child's name change:
- An Official Copy of the applicant's Family Register Entry (koseki touhon) as well from as the child
- A Revenue Stamp* (\ 800 / child)
- A Post Stamp (82 \), covering the cost of letters sent by the Family Court
* To cover the fees of procedures, Revenue Stamps are used. They can be purchased at the Official Bureas or Agencies.
The nearst Family Court from Kobayashi is the Branch Office in Miyakonojou.
